The assassin strikes, the victim's catlike reactions allow him to see the blade before it strikes (i.e. he wins initiative) twisting just enough that it strikes his shoulder rather than his neck (i.e. negating the sneak attack) but his surprise is such that he cannot get his blade out to strike first (i.e. he loses his action). Your issue is?

@Lexible I believe I did "... with the passive Wisdom (Perception) score" is the RAW default - active Wisdom (Perception) would require something to justify that activeness.

@LinoFrankCiaralli But you have "got the jump on it"; if you hadn't surprised it, it would have been able to do something before you as a result of beating your initiative, instead on its turn it can do nothing and you get to do something before it. If you are lucky enough to beat its initiative as well, you get to do two somethings.

@daze413 What does the character have to do with it? How to Play is about the players and the DM. The player knows because the DM told her; the character fails the save because the player described that and the DM agreed.
